Pilates Body in Balance
Please refrain from using our website or services if you disagree with any part of these Terms and Conditions.
The following Terms and Conditions have been established to facilitate your engagement with Pilates Body in Balance. We kindly request that you take the time to review them carefully. Information published on this website is intended for the benefit of its visitors. However, please be aware that while we have taken precautions to ensure technical and factual accuracy, occasional errors may occur. We do not guarantee the accuracy or completeness of the information on this website, and Pilates Body in Balance shall not be held liable for any consequences resulting from its use. We also do not warrant that the website, its contents, or hyperlinks are free of viruses or contaminants. We advise you to conduct your own virus checks and take necessary precautions in this regard.
AGREEMENT
Interpretation and Variation
1.1 In these Terms and Conditions, the following definitions apply:
1.2 References in the Terms and Conditions to the singular include the plural and vice versa, and references to the masculine gender include references to the feminine gender.
1.3 The Terms and Conditions are incorporated into the health questionnaire.
1.4 Pilates Body in Balance reserves the right to amend and revoke the Terms and Conditions as necessary or desirable for the regulation of the Studios and the conduct of Clients.
1.5 The Terms and Conditions are governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
Client Responsibilities.
2.1 Upon completing the health questionnaire or purchasing a block/class - whichever comes first, an individual becomes a Client of Pilates Body in Balance and is bound by these Terms and Conditions, subject to condition 2.2.
2.2 Acceptance as a Client is at the absolute discretion of Pilates Body in Balance. Acceptance of the Client's application constitutes a legally binding contract between Pilates Body in Balance and the Client under the terms and conditions of this agreement.
2.3 Pilates Body in Balance retains the right to expel, suspend, or refuse to renew the sessions of any Client whose conduct is, in the reasonable opinion of Pilates Body in Balance, injurious to the character of the Studio, breaches the Terms and Conditions, or is in the interest of other Clients. Expelled Clients cease to be Clients of the Studio and are not entitled to refunds during any suspension period.
2.4 Sessions in the Studio are personal to a Client and cannot be assigned, transferred, or otherwise disposed of.
Booking and Cancellation
3.1 Clients may book, reschedule, or cancel sessions via email, text, or by calling the Studio.
3.2 Clients must cancel or reschedule sessions with 24 hours' notice for Group or single classes or 48 hours' notice for Private's. Failure to do so will result in the Client being charged in full for the session.
3.3 Sessions for Privates or singles classes are allocated on a first-come, first-served basis, subject to availability. Monthly block session buyers have first option for the following month, before being offered out. Clients may join the waiting list for unavailable sessions. If a Client books a session from the waiting list, the Terms and Conditions apply as usual.
3.4 In the event that only one client attends a scheduled reformer class, the duration of the session will be adjusted to 50 minutes instead of the standard 1 hour.
In the event that 4 people or less attend a schedule matwork class, the duration of the session will be adjusted to 45 minutes instead of the standard 55 minute.
This does not apply to Privates sessions.
Studio Opening Times
4.1 Session times at Pilates Body in Balance may vary, including cancellations. Times are posted by the Studio and available at the Studio or on the Website.
4.2 Class availability is limited and operates on a first-come, first-served basis.
Payment Terms and Refund Policy
5.1 Class prices are determined by Pilates Body in Balance and may vary from time to time.
5.2 Before attending a session at Pilates Body in Balance, Clients must pay in full, book their session, and complete the health questionnaire, which is sent before the first session.
5.3 Payments for classes, monthly block fees, and annual payments are generally non-refundable and non-transferable, unless stated otherwise in the Terms and Conditions, except for any statutory right of cancellation.
5.4 Monthly block fees are to be paid promptly and in full accordance with the specified terms. Payment is due on the designated date of each month. Failure to submit payment by the stipulated due date will result in forfeiture of the client's position within the class and the vacant position will be allocated to the next eligible individual on the waiting list.
5.5 In the event that Pilates Body in Balance opt to provide a refund, it shall be processed through the original payment method utilized for the initial transaction.
Fitness and Health
6.1 Clients are advised to seek medical advice before engaging in strenuous physical activities if they have concerns about their physical condition. Pilates Body in Balance reserves the right to deny access if an individual's health may be at risk by using its facilities.
6.2 Any health concerns or issues must be disclosed in the health questionnaire and discussed with an instructor. If a Client answers affirmatively to any health questionnaire question, consulting a medical professional before starting classes at Pilates Body in Balance is strongly advised.
6.3 Clients must adhere to instructor instructions at all times.
6.4 Clients must inform a staff member of any injuries or conditions beyond what is listed in their health questionnaire.
Use of Facilities
7.1 The Studio may, without notice, temporarily withdraw facilities for cleaning, repair, maintenance, or other reasons beyond Pilates Body in Balance's control.
7.2 Individuals under 18 may use the Studio only when accompanied by an adult. Responsibility for children in the Studio rests with the accompanying adult, and Pilates Body in Balance is not liable for injuries to children on the Studio premises, except as required by law.
Safety and Hygiene
8.1 For safety and hygiene, no crockery or glass is allowed in the Studios. Clients must not walk barefoot and should always wear a fresh pair of socks.
8.2 The main entrance must be used when entering or leaving the Studios. Fire exits are clearly marked for safety and must not be interfered with.
8.3 In the event of a fire, Clients must proceed to the nearest available exit.
8.4 Smoking is prohibited in the Studio.
Personal Belongings
9.1 Personal belongings are brought to the Studio at the Client's own risk, and Pilates Body in Balance is not liable for loss or damage to such items.
9.2 Vehicles parked outside the Studio are parked at the Client's own risk, and Pilates Body in Balance is not liable for any loss or damage to such vehicles.
Limitation of Liability
10.1 Pilates Body in Balance is not responsible for the unavailability of specific sessions, instructors, or pilates equipment for any reason. Pilates Body in Balance may make alterations without notice and will not be liable for any loss resulting from such changes, except as required by law.
10.2 Clients are responsible for ensuring their capability to engage in exercise programs and sessions. Clients assume the risk of injury from exercises and equipment usage and are advised to consult a doctor before beginning any session. Advice from Pilates Body in Balance instructors does not replace medical advice.
10.3 Pilates Body in Balance is not liable for property loss or damage or for Client injuries on Studio premises or outside the Studio, except as required by law.
10.4 In consideration of their participation in the activities and programs of Pilates Body in Balance and the use of facilities and equipment owned and/or under the control of Pilates Body in Balance, the Client hereby waives and releases Pilates Body in Balance and its instructors from any and all responsibility or liability for injuries or damages resulting from their participation in any of the activities of Pilates Body in Balance or use of the equipment or facilities of Pilates Body in Balance, except in respect of death or personal injury caused by the negligent act or omission of Pilates Body in Balance.
General
11.1 Clients are required to notify Pilates Body in Balance of any change of home address or email address. Failing such notice, all communications will be assumed to have been received by the Client within five days of mailing to the last address (of either type) notified to Pilates Body in Balance.
11.2 Pilates Body in Balance may, if a Client so wishes, communicate with the Client by electronic mail ("email"). By providing an email address to Pilates Body in Balance, the Client consents to receiving email communications from Pilates Body in Balance, including notices pursuant to the Terms and Conditions. The Client also accepts the risk that email may not be a secure and confidential means of communication. Pilates Body in Balance will not be liable for any loss or damage suffered as a result of communicating with a Client by email.
11.3 Any marketing, educational, or other materials of this nature whatsoever produced by Pilates Body in Balance in connection with the Studio and made available to Clients at the Studio will at all times remain the property of Pilates Body in Balance and will be subject to the copyright of Pilates Body in Balance.
11.4 Usage of your personal information is governed by the privacy policy of Pilates Body in Balance, which forms part of these Terms and Conditions.
